Pre-nuptial Agreement

Pre-nuptial Agreements are formal agreements entered into by couples expecting to marry but wish to record what each is entitled to and their respective obligations towards the other in the event of a breakdown in the marriage.  There are a host of reasons for Pre-nuptial Agreements.  For example, one party may wish to protect family wealth and assets acquired pre-marriage or ensure that children from a previous relationship acquire a share of  the assets being brought into the marriage.

However, the law in England and Wales at present is in limbo on pre-nuptial agreements but  due to the migration of couples from country to country, these formal documents are testing the jurisdiction of our Courts which are called upon in the divorce process to give consideration to those agreements entered into by the parties which are legally recognised in a foreign jurisdiction, particularly parts of the EU in which they are common place.
